Certificate of Incapability – Capability

Under the Patients Property Act, a certificate issued by psychiatrist, a director of a designated mental health facility or a designated health authority staff in the community, stating that a ‘patient’ (in-patient or others) is incapable of managing property and finances.  The PGT will then take over the person’s finances and legal affairs (but not personal care or medical care). Also a certificate authorized by the Old Age Security Act and the Canada Pension Plan Act stating that a person is not capable of managing property (for a “pension trusteeship”).
